The Regulations

As part of the Health & Safety at Work (Asbestos) Regulations 2016, there is a duty for people in control of a place of work to identify, document and manage asbestos in the workplace, and to regularly review the management plan. The most effective way of identifying asbestos and asbestos containing materials (ACM’s) is to have a survey carried out by a qualified asbestos surveyor. According to the Health & Safety at Work Act a ‘workplace’ means a place where work is being carried out, or is customarily carried out, for a business or undertaking; and includes any place where a worker goes, or is likely to be, while at work.

Regulations apply to owners of commercial buildings, or a landlord of a commercial or residential building built prior to the year 2000.
WorkSafe New Zealand recommends that people in control of a place of work prepare an asbestos register by arranging for an asbestos survey of their workplace by a qualified professional.
As a PCBU you have a duty to make sure, so far as is reasonably practicable, that all asbestos or ACM in your workplace is identified and if there is ACM’s present that there is no risk of exposure to respirable asbestos fibres.

We recommend against taking a sample unless you are trained to do so, this is due to the risk of unnecessary asbestos exposure.
